Beta Agreement

This Beta Agreement applies between you ("Beta Participant") and the operator of AnCore ("Operator"; see Privacy Policy §1) for your use of the AnCore service during the closed beta phase.

1. Beta Status and Scope

• Access is by invitation only. Use during the beta is free of charge.
• The beta is intended exclusively for entrepreneurs within the meaning of § 14 German Civil Code (BGB). By confirming, you declare that you use AnCore in the course of your trade, business or self-employed professional activity.
• AnCore is in active development. Features may change, become temporarily unavailable, or be removed without prior notice.
• No availability, performance, or functionality guarantee is provided (no SLA).
• All results from AnCore are decision aids for the early planning phases:
  • Structural results are a preliminary design. They do not replace a verifiable structural calculation or proof of structural stability by a responsible structural engineer.
  • Cost and CO₂ figures are estimates based on published benchmark values (e.g. BKI, ÖKOBAUDAT) and serve as orientation in early phases. They replace neither a cost estimate according to DIN 276 nor a life-cycle assessment or evidence for QNG, DGNB or other certifications.
  • Texts from the AI assistant may be wrong. The results shown by the computation engine are authoritative.
• Before you use results in your planning, check them under your own responsibility.
• Change of operator: we may transfer our rights and obligations under this agreement to a company we set up to operate AnCore in the future. We will inform you in advance in text form; you may end your participation at any time under Section 7.

2. Your Project Data

You may work on test geometries and real projects in AnCore. The following applies:

• Do not enter identifying information about third parties – no names of clients or building owners, no addresses, no names of persons. This also applies to project and variant names, descriptions and inputs into AI features. Use generic labels, e.g. "Residential building, variant A".
• Do not work on projects in AnCore that are classified or subject to special confidentiality requirements.
• You ensure that you are permitted to use the project data in AnCore, in particular under your contracts with clients.
• If personal data of third parties is to be processed in an individual case, we will first conclude a data-processing agreement under Art. 28 GDPR.

3. Pilot Programme

• Every access we activate for a firm during the beta is part of our pilot programme. It starts when the first account of your firm is activated and runs for three months.
• Participation is free of charge. There is no purchase obligation; paid use requires an explicit booking.
• During these three months we support you in introducing and operating AnCore: onboarding, questions about the software and, on request, setting up your project together (e.g. taking over the geometry from an IFC file). Checking the inputs and assessing the results remain your responsibility.
• We provide no planning or engineering services and give no professional assessment of your building project. Results from models we set up together with you are decision aids under Section 1 like all other results.
• During this time we ask you for feedback on AnCore; Section 5.1 applies. We arrange the appointments informally with you.
• After the three months our support ends. Your access remains for as long as the beta runs and can be ended by either side at any time under Section 7.
• At your firm's request we exclude your accounts from use for model development (Section 5.2). The exclusion takes precedence over any consent given and is visible in the project settings.
• By accepting this agreement you confirm that you are entitled to use AnCore for your firm.
• We will name you as a reference only with your prior, separate consent in text form.
• On request we conclude a data-processing agreement under Art. 28 GDPR (Section 2).
• Participation creates no exclusivity and no obligation to further services on either side.

4. Operator Access and Confidentiality

• The Operator may access your project content where there is a specific reason: support requests, the agreed support within the pilot programme, error analysis, or response to security incidents. The Operator may additionally, on request, reset a password or search the user database to handle a support request.
• Every operator access is logged in an audit log whose entries are not modified after they are written and are deleted automatically once the retention period has expired: timestamp, acting administrator account, affected account, action.
• Project content is never viewed without a specific reason.
• We treat your project content confidentially. We do not pass it on to third parties – except to the processors named in the Privacy Policy, within the scope described there – and we do not publish it.
• Legal basis: Art. 6(1)(b) and (f) GDPR. Full details, the complete list of logged actions, and retention periods: Privacy Policy §2.4 and §2.5.

5. Use of Beta Data

5.1 Feedback

Feedback, bug reports, and improvement suggestions you provide may be used by the Operator to further develop AnCore – without restriction and without separate compensation. Your project content is not feedback within the meaning of this section.

5.2 Use of your project content for AI training – only with your consent

Your project content is not used to train or develop machine-learning models unless you have expressly consented in advance. Consent is voluntary, has no effect on your participation in the beta or the pilot programme, and can be withdrawn at any time with effect for the future – in the project settings or by email to the address given in the Privacy Policy. You give consent only for projects whose data you are entitled to use. If consent is given, we extract technical parameters (geometry, loads, computation results) in anonymised form; identifying information is removed at extraction. Details: Privacy Policy §2.6. Administrator debug copies (Section 4) are never used for training. If your firm has excluded such use under Section 3, that exclusion takes precedence over any consent given.

5.3 Use of external AI services (Anthropic)

AnCore includes AI-supported features (AI Chat, Lazy Design and the AI insight on cost and life-cycle assessment) that use Anthropic's language model (USA). We transmit the text you enter into these features and – where the feature requires it – an automatically generated technical summary of the current model and the latest computation. Uploaded files, project and variant names and descriptions are not transmitted. Under its commercial terms Anthropic does not use this data to train its models. The structural computation works without these features. Other features with "AI" in their name do not transmit any data to Anthropic (Privacy Policy §2.7).

6. Confidentiality of Unreleased Features

• The beta contains features not yet publicly released. You undertake not to publicly share screenshots, videos, or detailed descriptions of unreleased features without informing the Operator in advance.
• General mentions ("I am taking part in the AnCore beta") are expressly permitted.

7. Termination and Data Deletion

• You may end your participation at any time without notice by sending an email to the contact address listed in the Privacy Policy or by choosing "Delete account" in the account settings.
• The Operator may terminate the beta as a whole or individual access at any time – in particular in the event of a breach of this agreement.
• On termination, your account and project data will be deleted once 30 days have passed; audit-log entries are excepted (see Privacy Policy), as is – only if consent was given under Section 5.2 – already-anonymised training data that no longer contains personal data. Backup copies are deleted as part of the regular rotation after no more than 16 days.
• On request we confirm the deletion in text form.

8. Liability

• As AnCore is provided free of charge during the beta, the Operator is liable only for damages caused by intent or gross negligence, and for damages from injury to life, body, or health (§§ 521, 599 German Civil Code, applied by analogy).
• In particular, the Operator assumes no liability for the correctness of computation results, data loss, downtime, or indirect consequential damages.

9. Data Protection

The Privacy Policy at /privacy applies in addition. This Beta Agreement does not modify or curtail your rights under the GDPR.

10. Applicable Law

The law of the Federal Republic of Germany applies.

Acknowledgment

By confirming during the invitation/registration process, you declare that you have read this Beta Agreement and the Privacy Policy and agree to the provisions contained therein.
